Estudio comparativo entre México, España, Estados Unidos de América y Chile sobre el derecho de acceso a la información pública

Abstract

El objetivo de realizar un estudio comparado es comprender las similitudes y diferencias presentes en la regulación del derecho de acceso a la información en cuatro sistemas jurídicos: México, España, Estados Unidos de América y Chile. En particular, examinamos la estructura del proceso establecido en la legislación de cada país en relación con el acceso a la información, incluyendo sus antecedentes legislativos, el procedimiento para obtener la información, las limitaciones, los organismos encargados de garantizarlo y los plazos para su aplicación. Utilizando un enfoque comparativo, hemos obtenido un panorama detallado de las coincidencias y discrepancias entre las distintas legislaciones, lo que nos ha permitido identificar tanto aciertos como deficiencias implementadas por cada Estado. Otro aspecto explorado en nuestro estudio comparativo se relaciona con la sentencia Claude Reyes y Otros vs. Chile, una resolución emitida por la Corte Interamericana de Derechos Humanos. Su relevancia radica en que fue la primera sentencia en abordar una controversia sobre la obstrucción al acceso a la información en el ámbito interamericano. A raíz de este fallo, los Estados parte de la Convención Americana sobre Derechos Humanos comenzaron a abordar la legislación en este ámbito. Esta sentencia se considera un punto de inflexión que ha transformado la garantía del derecho a acceder a la información pública.
