Quelques réflexions sur la nouvelle loi 95-17 relative à l'arbitrage au Maroc

Abstract

Le Maroc a connu un développement économique significatif ces dernières années, ce qui a entraîné la nécessité de simplifier et d'accélérer les procédures liées à l'investissement, notamment dans le domaine de l'arbitrage. Celui-ci présente des avantages majeurs tels que la confidentialité et la rapidité dans la résolution des litiges, ce qui en fait un mécanisme attractif pour les parties impliquées dans des transactions commerciales. Dans le droit de l'arbitrage au Maroc, la loi 08-05 a été critiquée en raison de ses insuffisances et de ses imperfections, ce qui a conduit à l'adoption de la nouvelle loi 95-17. L'objectif de cette nouvelle loi est de renforcer le cadre juridique de l'arbitrage au Maroc en introduisant d'importants changements visant à améliorer son efficacité et à favoriser son utilisation. Cet article permettra d'examiner les développements et les exigences découlant de ce nouveau dispositif juridique au Maroc. Il se penchera également sur les contributions spécifiques de cette nouvelle loi à l'amélioration de l'efficacité de l'arbitrage dans le pays. Par ailleurs, il permettra d'analyser les pistes d'amélioration, en particulier en ce qui concerne l'intervention du juge officiel dans la procédure d'arbitrage.
