A CRIAÇÃO DE MUNICÍPIOS APÓS A EC 15/96: UMA ANÁLISE EM BUSCA DA EFETIVIDADE DO TEXTO CONSTITUCIONAL

Abstract

O artigo procurou compreender a luz da filosofia do Direito a possibilidade de criação de novos municípios após a edição da emenda constitucional 15/96. Nesse sentido, procurou-se a priori ponderar as teorias, positivista e pós-positivista, entendendo ser admissível a conjunção dessas teorias para melhor prestação do serviço jurisdicional em casos concretos de maior complexidade. Em segundo momento, foi elencado as opções que o Supremo Tribunal Federal detinha para julgar o mérito da ação direta de inconstitucionalidade 2240 que impugnou a criação de municípios após a EC 15/96. Por último, a pesquisa avaliou a lei 2.264/10 que criou o município de Extrema de Rondônia, assim como a inércia do Congresso Nacional ao não elaborar a Lei Complementar Federal regulamentando a criação de novos municípios, conforme previsão do artigo 18 §4º da Constituição da República Federativa do Brasil. Esta análise permitiu concluir que a criação de municípios pode ser feita mediante lei estadual, enquanto não elaborada a Lei Complementar Federal em razão da busca de efetividade da Carta Magna verificada na densidade normativa dos princípios correlatos a hard case estudada.
