Abstract

Resumen La educación se encuentra enmarcada en un proceso de enseñanza y aprendizaje impartido y difundido por los educadores, al desarrollar lo que se conoce bajo la ley y la dogmática educativa como la función docente; la misma es ejercida en las instituciones públicas del estado venezolano y en instituciones privadas. Así mismo los profesores, en especial referencia a los del Estado, en sus diferentes niveles territoriales, se encuentran bajo el régimen disciplinario, llamado en la doctrina jurídica como sanción administrativa bajo las figuras de amonestación y/o destitución del cargo. El objetivo del trabajo fue analizar los postulados teóricos legales del régimen sancionatorio funcionarial del docente establecido en la legislación venezolana y la pertinencia de su aplicación por parte de los superiores. Se fundamentó en el análisis de la constitución, leyes, reglamentos y aportes doctrinarios de Durán (2014); Rojas (2011), Becerra (2009); Brewer (1980), entre otros. La metodología empleada fue documental de tipo descriptivo. Luego del análisis realizado se resalta que el proceso disciplinario se lleva a cabo en dos fases; las cuales, en aquellos casos, en que un profesor presuntamente hubiere incurrido en hechos que pudiera ser calificados y ameriten la separación del cargo, o, destitución e inhabilitación; se ordenará llevar a cabo la respectiva averiguación administrativa inicial, la cual determinará la responsabilidad docente establecida en los diversos postulados de ley.
