O INQUÉRITO POLICIAL Á LUZ DO ESTADO DEMOCRÁTICO DE DIREITO

Abstract

Este trabalho tem como objetivo analisar o caráter inquisitivo do inquérito policial em relação às garantias do exercício da advocacia e aos crimes de abuso de autoridade. São examinados aspectos como a presença do advogado no interrogatório, o acesso aos autos do inquérito e os limites do sigilo na investigação. No contexto de um sistema acusatório e de respeito aos direitos fundamentais, o papel do advogado é fundamental na defesa do indiciado, atuando como uma força contrária ao Estado acusador. A legislação referente aos crimes de abuso de autoridade estabelece punições para aqueles que, sem justa causa, impedem a entrevista pessoal e reservada do preso com seu advogado, destacando a importância da presença do defensor. Embora o inquérito policial possua características inquisitivas, é importante ressaltar que o Estado Democrático de Direito estabelece limites e garantias que assegurem o respeito aos direitos do investigado. O amplo acesso do advogado aos elementos de prova documentados durante a investigação, assim como o direito de examinar autos e tomar anotações, permite a concretização do contraditório e influência nas diligências, evitando abusos e constrangimentos. O método de pesquisa adotado é principalmente bibliográfico, com uma abordagem analítica. As reflexões são embasadas nos ensinamentos de renomados autores, como Noberto Avena, Marta Cristina Cury Saad Gimenes, Aury Lopes Júnior e Luís Gonzaga da Silva Neto. Essas referências contribuem para uma análise aprofundada sobre o tema proposto, proporcionando uma compreensão mais ampla do caráter inquisitivo do inquérito policial e sua relação com as garantias do exercício da advocacia e os crimes de abuso de autoridade.
