MULHER ENCARCERADA: DISPOSITIVOS LEGAIS DE PROTEÇÃO A MATERNIDADE

Abstract

Sempre existiram nas sociedades humanas indivíduos que colocassem a teste os regramentos sociais estabelecidos pela sociedade. E, consequentemente, a questão do que fazer com aqueles que violam as regras das autoridades, para tal foram criadas as prisões, majoritariamente masculinas. A separação física de homens e mulheres no interior das prisões públicas, embora tenha ocorrido tentativas de aplicação anteriores, só foi nacionalmente regulamentada com o Código Penal de 1940. A partir de investigação bibliográfica associada à intensa e ampla pesquisa documental e referências bibliográficas, o presente trabalho vem contribuir para a prática referente a perspectiva da mulher e principalmente da mãe encarcerada, a proteção dessa mãe, e a sua realidade no cotidiano da penitenciária. As proteções infraconstitucionais são apresentadas no trabalho, como a garantia de assistência à maternidade consubstanciado no art. 83, §2º da LEP; art. 89 seção especial para gestantes e parturientes, com creche para abrigar crianças de seis meses até sete anos de idade; agentes do sexo feminino nessas dependências, de acordo com o art. 83, §3º da LEP; atendimento especial voltado à gestante, incluindo atendimento ao recém-nascido, de acordo com o Art. 14. Já em relação a proteção constitucional, apresentou-se o art. 3º, inciso IV; o art. 5º; o art. 2º da Declaração Internacional de Direitos Humanos (ONU); artigo 23, referente a Regra Mínima para Prisioneiros, aborda as questões específicas das mães presas; o inciso XLV do art. 5º da CF; o artigo art. 5º, XXXV e LXXIV da Constituição Federal. Também serão apresentados no presente trabalho, em contraponto a legislação, o que ocorre na realidade da mulher detenta.
