Abstract

Este trabalho buscou compreender o surgimento e evolução histórica do sistema prisional brasileiro, desde as primeiras prisões coloniais até os dias atuais. Foram apresentados os conceitos de pena, suas funções e a sua aplicação no contexto brasileiro. Além disso, foram discutidos os desafios enfrentados pelo sistema prisional, como a superlotação, a violência e a falta de infraestrutura, que dificultam a ressocialização do preso e aumentam as taxas de reincidência. Foi possível perceber que, apesar de a ressocialização ser um objetivo declarado do sistema prisional, muitas vezes ela é negligenciada em favor de uma lógica meramente punitiva. A superlotação e as más condições de vida nos presídios também contribuem para a perpetuação do ciclo de violência e criminalidade. Diante desse cenário, é fundamental que sejam implementadas políticas públicas que garantam a dignidade dos presos e incentivem a sua ressocialização. Investir em educação, qualificação profissional, assistência jurídica e psicológica pode contribuir para a reinserção social dos presos e para a redução da criminalidade.

This paper aimed to understand the emergence and historical evolution of the Brazilian prison system, from the first colonial prisons to the present day. The concepts of punishment, its functions, and its application in the Brazilian context were presented. In addition, the challenges faced by the prison system, such as overcrowding, violence, and lack of infrastructure, which hinder prisoner rehabilitation and increase recidivism rates, were discussed. It was possible to perceive that, although rehabilitation is a declared goal of the prison system, it is often neglected in favor of a purely punitive logic. Overcrowding and poor living conditions in prisons also contribute to the perpetuation of the cycle of violence and criminality. In this scenario, it is essential to implement public policies that guarantee the dignity of prisoners and encourage their rehabilitation. Investing in education, vocational training, legal and psychological assistance can contribute to the social reintegration of prisoners and the reduction of crime.
