Постановка проблеми. У статті сформульовано теоретико-гносеологічну конструкцію феномену ступеня тяжкості шкоди, заподіяної здоров’ю тварини, в судово-ветеринарній експертизі. Стверджується, що ступінь тяжкості шкоди, заподіяної здоров’ю тварини, є порівняльною величиною, що характеризує розмір шкоди, завданої здоров’ю тварини внаслідок тілесного ушкодження. Мета статті – розробити та обґрунтувати теоретико-гносеологічну конструкцію феномену ступеня тяжкості шкоди, заподіяної здоров’ю тварини, та показати шляхи реалізації цього феномену в практиці судово-ветеринарної експертизи. Методологічною основою дослідження є системний підхід, зумовлений специфікою теми роботи й пов’язаний із використанням загальнонаукових і спеціальнонаукових методів, серед яких аналіз, синтез, аналогія для визначення сутності категоріального апарата феномену ступеня тяжкості шкоди, заподіяної здоров’ю тварини; формально-логічний – для впорядкування алгоритму визначення ступеня тяжкості шкоди, заподіяної здоров’ю тварини, логіко-граматичний; логіко-юридичний – для з’ясування етимологічного змісту понять; системно-структурний – для систематизації та структурування ступенів тяжкості шкоди, заподіяної здоров’ю тварини; метод моделювання – використовувався під час прогнозування, розроблення проблеми. Результати. Доведено, що виражати тяжкість шкоди, заподіяної здоров’ю тварини, доцільно таким виміром, як ступені. У зв’язку із цим запропоновано виокремлювати три ступені тяжкості шкоди здоров’ю: тяжкий, середньої тяжкості та легкий. Наведено критерії та ознаки кожного ступеня, які й використовуються в практиці судово-ветеринарної експертизи. Висновки. Аргументовано, що ознаками шкоди, заподіяної здоров’ю тварини, тяжкого ступеня є такі: небезпека для життя й загроза загибелі тварини, загроза втрати або відбувся факт втрати будь-якого органа чи втрата органом його функцій, розлад здоров’я, який спричиняє стійке порушення режиму звичного існування (життя) домашньої тварини, втрату нею здатності до виконання корисної роботи або стійкої втрати можливості самостійного існування дикої (безпритульної) тварини в навколишньому середовищі, загроза переривання або відбувся факт переривання вагітності, невиправне знівечення морди чи інших частин тіла (екстер’єру). Показано, що небезпечними для життя є ушкодження, які в момент заподіяння (завдання) або через певний проміжок часу призводять до смерті. Не загрозливими для життя ушкодженнями тварин, що належать до тяжких за наслідками травми, є втрата будь-якого органа чи втрата органом його функцій, зокрема втрата зору, слуху, нюху, кінцівок, язика й репродуктивної здатності тварини. Доведено, що ушкодження екстер’єру тварини є ознакою тяжкого тілесного ушкодження, отже, залежно від виправності ушкодження екстер’єру може бути виправним чи невиправним. Останнє може знівечувати чи не знівечувати екстер’єр тварини. Показано, що виправністю ушкодження є значне зменшення вираженості патологічних змін (рубця, деформації, порушення рухливості м’яких тканин тіла тварини тощо) із часом чи під дією нехірургічних засобів. Якщо ж для усунення необхідне оперативне втручання, то ушкодження екстер’єру є невиправним. Знівеченням екстер’єру тварини є не властиві їй фізичні вади, які проявляються в незвичному, протиприродному, скаліченому, понівеченому, потворному, жахливому, відразливому вигляді тварини. Установлено, що критеріями шкоди, заподіяної здоров’ю тварини, середньої тяжкості є: відсутність ознак небезпечних для життя; відсутність наслідків шкоди, заподіяної здоров’ю тварини, у вигляді втрати будь-якого органа, частини тіла або втрати органом його функцій; тривалий розлад здоров’я строком понад 21 добу; стійка тривала втрата працездатності тварини строком понад 21 добу. Констатовано, що ознаками шкоди, заподіяної здоров’ю тварини, легкого ступеня є: по-перше, ушкодження, що мають незначні скороминущі наслідки, тривалістю не більше ніж 6 діб, за відсутності короткочасного розладу здоров’я та відсутності незначної стійкої втрати здатності тварини до виконання корисної роботи; по-друге, короткочасний розлад здоров’я тварини та незначна стійка втрата її здатності до виконання корисної роботи, тривалістю понад 6 діб, але не більше ніж 21 добу. Problem statement. The article formulates the theoretical and epistemological construction of the phenomenon of the degree of severity of damage caused to the animal's health in forensic veterinary examination. It is argued that the degree of severity of the damage caused to the animal's health is a comparative value that characterizes the amount of damage caused to the animal's health as a result of physical injury. The purpose of the article is to develop and justify the theoretical and epistemological construction of the phenomenon of the degree of severity of damage caused to the animal's health and to outline the ways of its implementation in the practice of forensic veterinary examination. The methodological basis of the research is a systematic approach determined by the specifics of the work topic and associated with the use of general scientific and special scientific methods, including analysis, synthesis, analogy to determine the essence of the categorical apparatus of the phenomenon of the degree of severity of damage caused to the animal's health; formal-logical – to streamline the algorithm for determining the damage severity degree caused to the animal's health, logical-grammatical; logical and legal – to clarify the etymological content of concepts; systemic-structural – for systematization and structuring of damage severity degree caused to the animal's health; modeling method – used during forecasting and problem development. The results. It has been proven that it is expedient to express the severity of the damage caused to the animal's health by measures such as degrees. In this regard, it is proposed to distinguish three degrees of severity of damage to health: severe, moderate and light. The criteria and signs of each degree, which are used in the practice of forensic veterinary examination, are given. Conclusions. It is argued that the signs of severe damage to the health of an animal are as follows: danger to the life and threat of death of the animal, threat of loss or actual loss of any organ or loss of its functions by an organ, health disorder that causes persistent impairment the usual mode of existence (life) of a domestic animal, its loss of ability to perform useful work or permanent loss of the possibility of the independent existence of a wild (homeless) animal in the surrounding environment, the threat of termination or the fact of termination of pregnancy, irreparable disfigurement of the muzzle or other parts of the body (exterior). It is shown that life-threatening injuries are injuries that lead to death at the time of occurrence (task) or after a certain period of time. It is shown that the repairability of the injury is a significant reduction in the severity of pathological changes (scars, deformations, impaired mobility of the soft tissues of the animal's body, etc.) over time or under the influence of non-surgical means. When surgical intervention is required for removal, the damage to the exterior is irreparable. Disfigurement of an animal's exterior is physical defects that are not characteristic of it, which are manifested by an unusual, unnatural, mutilated, mutilated, ugly, very ugly, disgusting, terrible, repulsive appearance of the animal. It was established that the criteria for damage caused to the health of an animal of medium severity are: absence of life-threatening signs; absence of consequences of damage caused to the health of the animal, in the form of loss of any organ, part of the body or loss of its functions by the organ; long-term health disorder lasting more than 21 days; persistent long-term loss of the animal's working capacity for more than 21 days. It was established that the signs of damage caused to the health of an animal of a light degree are: firstly, injuries that have insignificant transitory consequences lasting no more than 6 days, in the absence of a short-term health disorder and in the absence of a slight permanent loss of the animal's ability to perform useful work; secondly, a short-term disorder of the animal's health and a slight permanent loss of its ability to perform useful work lasting more than 6 days, but not more than 21 days.
