The European Probation Standard derives from the legislation adopted at community level, the recommendations and resolutions adopted by the Committee of Ministers of the Council of Europe and the Decisions of the Council of the European Union, based, including on the Minimum Rules of the United Nations, being legal benchmarks for the adoption of the internal legislation of the member states of the Council of Europe. The special criminal system regarding minors corresponds, as is natural, to an adequate procedural regulation, determined by the legislator's concern for their protection in difficult conditions. Due to the particular physical and mental state of minors, they benefit from a separate legal status, different from that of adults, reflected both in the educational system and in the plan of legal liability. The important issue that arises in the matter of legal responsibility is the lower age limit from which the minor is criminally liable, i.e. the age from which the minor is aware of his actions and the consequences of his actions. The minor becomes the subject of probation only if he reaches the age of criminal responsibility required by internal law. In this context, probation is called to reform the juvenile justice system by mitigating criminal repression regarding minors who commit criminal acts.
