IMPLICAÇÕES DAS NEGOCIAÇÕES COLETIVAS NOS CONTRATOS DE TRABALHO INDIVIDUAIS – O CONFRONTO COM PRINCÍPIOS TRABALHISTAS

Abstract

As negociações coletivas de trabalho são instrumentos capazes de alterar as cláusulas mantidas nos contratos individuais de trabalho em determinadas situações. Antes da reforma trabalhista (Lei nº 13.467/2017) as possibilidades de redução de direitos pela via negocial eram restritas e passam a ser possibilidade pacífica, principalmente após a decisão de repercussão geral do STF no ARE 1121633. Objetivou-se, com este trabalho, portanto, analisar a possibilidade das negociações coletivas no Direito brasileiro, com base no art. 7º, XXVI, da Constituição da República Federativa do Brasil de 1988 – CRFB/88 e os limites impostos a tais negociações pelos próprios princípios constitucionais, interpretados pela doutrina e jurisprudência. Após o estudo, entendeu-se que a Lei 13467/2017, no que tange à possibilidade de sobreposição do negociado ao legislado, viola princípios constitucionais implícitos e expressos e, por isso, deveria ter sido declarada inconstitucional pelo STF, que mantém tese inconstitucional sobre a matéria.
