Abstract

The Holy Prophet (s.a) during both Mecca/Makkah and Medina, he was a party to many written or oral treaties with polytheists. The first of these is considered to be a member of the Organization of Hilfu'l-Fudul in Mecca during the period of ignorance. The real treaties that the Holy Prophet was a party to showed themselves in the form of written agreements he made in the status of the head of state after the migration to Medina. The Medina Agreement, prepared for the existing tribes living in Medina in the first year of the hijra, laid the first foundations of the Islamic State of Medina. In the second (623) year of the Hijra, different styles of Damre, Gıfar and Juheyna, Müdlic, Eslem; the fifth year (627) Gatafan, Abd Adi and Fezare; in the sixth year (628), Hudaybiyah was made with the polytheists of Mecca; in the later period, some treaties were made with polytheists such as Huzaa and Sakif. In all these treaties, The attitudes and practices of the Holy Prophet constituted a source for the Islamic State Law literature. As a matter of fact, Imam Muhammad tried to give them systematically in her work called Siyar al-kabir. In this study, we also had the opportunity to compare es-Siyerü'l-kebir, which is considered to be one of the first sources of Islamic International Law, and Hugo Grotius's War and Peace Law, which is considered a pioneer in this field by the westerners. In this context, we have tried to evaluate the similarities or differences in the basic principles of both laws within the framework of both classical sources of Islamic law and western sources.

Hz. Peygamber (s.a) gerek Mekke gerekse Medine döneminde müşriklerle yazılı veya sözlü pek çok antlaşmanın tarafı olmuştur. Bunların ilki Câhiliye döneminde Mekke’de Hilfü’l-Fudûl teşkilatına üye olması kabul edilirken Hz. Peygamber’in taraf olduğu asıl muâhedeler Medine’ye hicretten sonra devlet başkanı statüsünde yazılı olarak yaptığı antlaşmalar şeklinde kendisini göstermektedir. Hicretin birinci yılında Medine’de yaşayan mevcut kabilelere yönelik hazırlanan Medine Vesikası (Sahife), Medine İslâm Devleti’nin ilk temellerini atmıştır. Hicretin ikinci (623) yılı farklı aralıklarla Damre, Gıfâr ve Cüheyne, Müdlic, Eslem; beşinci yılı (627) Gatafan, Abd b. Adî ve Fezâre; altıncı yılı (628) Mekke müşrikleriyle Hudeybiye; daha sonraki süreçte ise Huzâa ve Sakîf gibi müşrik kabilelerle bazı antlaşmalar yapılmıştır. Tüm bu antlaşmalarda Hz. Peygamber’in takınmış olduğu tavır ve uygulamalar İslam Devletler Hukuku literatürüne kaynaklık teşkil etmiştir. Nitekim İmam Muhammed es-Siyerü'l-kebîr adlı eserinde bunları sistematik olarak vermeye çalışmıştır. Bu çalışmada ayrıca İslâm Devletler Hukuku’nun ilk kaynaklarından sayılan es-Siyerü'l-kebîr ile bu alanda batılıların öncü kabul ettikleri Hugo Grotius’un Savaş ve Barış Hukuku isimli eserlerini yer yer mukayese etme imkânı bulduk. Bu bağlamda her iki hukukun temel prensipleri hususunda benzer veya farklı yönlerini gerek İslâm hukuku klasik kaynakları gerekse batılı kaynaklar çerçevesinde değerlendirmeye çalıştık.
