Abstract

Anglo-sakson huquq tizimi bo’yicha belgilangan shartnomaviy majburiyatlar bo’yicha qoidalarni to’laligicha romano-german huquq oilasiga mansub davlatning qonunchiligiga kiritib bo’lmaydi. Sud pretsidentini asos qilib keltiruvchi ingliz huquqida juda ko’p yillik sud amaliyoti mavjud. Hattoki o’z davlatida hali mavjud bo’lmagan pretsidentni boshqa anglo-sakson huquq tizimli davlatning pretsidentini asos qilib qaror chiqarishi mumkin. Shartnomaviy huquqda xalqaro shartnomaviy majburiyatlar eng yetakchi ahamiyat kasb etishi, ya’ni jismoniy va yuridik shaxslar o`rtasidagi munosabatlarning kelib chiqishi aynan mana shu asosga to`g`ri kelishi mumkin.
