Abstract

O estudo adiante desenvolvido se presta a analisar, sob um prisma hermenêutico argumentativo, a temática relativa à falta da regulamentação do procedimento dos tribunais de 2º grau, notadamente em seus Regimentos Internos, sobre a orientação do plenário e do órgão especial expressa pelo art. 927, inciso V, CPC/2015. Isso pois, a falta de procedimento de identificação e formalização da orientação do plenário e do órgão especial gera impossibilidade de tratar tais entendimentos como precedentes vinculantes. Nesse sentido, com o intuito de explorar o tema em sua completude, analisa-se o surgimento e a peculiaridade de cada modelo jurídico presente no Ocidente que são a Civil Law e a Common Law conjuntamente com as suas influências no ordenamento jurídico brasileiro. Posteriormente, serão apresentados os elementos necessários para formação e aplicação do precedente: a doutrina do Stare Decisis e os elementos componentes do precedente ratio decidendi, obiter dictum, distinguishing e overruling. Importa frisar que a falta da regulamentação no Regimento Interno dos tribunais de segundo grau sobre a utilização do precedente vinculante referente à orientação do plenário ou do órgão especial, destes tribunais, gera o problema jurídico da impossibilidade de tratar tais entendimentos como precedentes vinculantes, visto que esses tribunais são silentes sobre o procedimento da formação e aplicação desses entendimentos.
