La contradicción de tesis 293/2011, que resulta de la interpretación del artículo primero de la Constitución Política de los Estados Unidos Mexicanos vigente, resuelta por la Suprema Corte de Justicia de la Nación, refiere que a los derechos humanos de fuente internacional se les reconoce el mismo rango que los previstos en la norma suprema y que ante una restricción expresa en ella al ejercicio de los derechos humanos, se deberá estar a lo que indica la norma Constitucional, esto es, se privilegian las restricciones, lo que genera que sea la propia jurisprudencia, restrictiva de los derechos humanos y no la Constitución, siendo ésta, la que debería estar por encima de jurisprudencia y ésta última, únicamente interpretativa mas no materialmente reformativa de la Constitución.
