Abstract

O presente artigo apresentado ao curso de graduação em Direito do Centro Universitário de Goiatuba, tem como objeto de estudo a possibilidade do reconhecimento do vínculo empregatício da relação entre a empresa Uber e seus colaboradores, trazendo a discussão as inconsistência jurisprudências acerca do assunto, desde os critérios para o reconhecimento do vínculo empregatício, até a “uberização”¹ das relações de trabalho e a relação com o dumping social². Neste contexto, será discutida a falta de regulamentação dessas relações de trabalho, a presença ou não dos critérios para o reconhecimento do vínculo empregatício, a uberização e a precarização das relações de emprego, a insegurança jurídica causada pela divergência jurisprudencial entre as turmas do Tribunal Superior do Trabalho, motivando, dessa forma, a confecção do presente projeto. As plataformas digitais, vem trazendo impactos relevantes para a forma de trabalho humano, surgindo um novo fenômeno conhecido como “crowdsourcing” ou mesmo a uberização, termo que se tornou popular no Brasil. Nesse ramo os motoristas são considerados como empresários autônomos. Apesar disso, esses motoristas não são protegidos por nenhum direito trabalhista, visto que essa modalidade não se enquadra nos tradicionais pressupostos da relação de empregado e empregador.
