Abstract

Il contributo è dedicato all’analisi della documentazione relativa alla procedura stragiudiziale a Genova tra la seconda metà del XII secolo e il primo quarto di quello successivo. Si è rivolta l’attenzione alla struttura e alle forme di convalidazione dei pochi lodi arbitrali pervenuti in originale i quali presentano tra loro una disomogeneità che dà vita a una pluralità di esiti difficilmente riconducibile entro uno schema. L’inserimento a inizio Duecento della peticio all’interno del tenor dell’arbitrato e alcuni dossier presenti nei protocolli notarili hanno permesso di ampliare il discorso alla procedura che sta a monte delle sentenze. Dal confronto tra i lodi arbitrali e le sentenze emanate dalla giustizia ordinaria è infine emersa per entrambi una evoluzione che procede in modo pressoché sincrono su binari paralleli, una concomitanza questa che non può essere casuale ma della quale rimangono sconosciute le ragioni.

The contribution is dedicated to the analysis of the documentation concerning the extrajudicial procedure in Genoa between the second half of the 12th and the first quarter of the following century. Attention has been paid to the structure and forms of validation of the few arbitration sentences that have come down to us in original form, whose lack of homogeneity gives rise to multiple outcomes that are difficult to place within a fixed scheme. The inclusion of the peticio in the tenor of the arbitration at the beginning of the 13th century and certain dossiers in the notarial protocols have made it possible to extend the discussion to the procedure underlying the sentences. A comparison between arbitration sentences and judgments issued by ordinary justice has finally revealed an almost synchronous evolution on parallel paths, a coincidence that cannot be accidental, but the reasons underlying it remain unknown.
