Abstract

Abstract (IT) L���articolo ha lo scopo di illustrare il quadro normativo in cui ascrivere la tutela del software, in funzione della sua peculiare dicotomia tra opera letteraria e invenzione. Infatti il software �� innanzitutto linguaggio, ovvero un complesso di istruzioni informatiche che compongono un programma per elaboratore. Se tale espressione �� dotata di creativit�� e originalit��, pu�� essere invocata la tutela offerta dal Diritto d���Autore. Quando il software �� in grado di sviluppare un effetto tecnico ulteriore e offrire soluzioni ad un problema tecnico si potr�� verificare la sussistenza degli ulteriori requisiti necessari e sufficienti affinch�� possa essere invocata la tutela brevettuale. In ambito medicale, i software e, in particolare, le App sono divenute un costante ausilio per gli operatori sanitari. Oltre alla difficolt�� nell���individuazione della tutela invocabile occorre altres�� considerare le autorizzazioni necessarie affinch�� le App possano essere validate e usate come dispositivo medici. Abstract (EN) This article is aimed at illustrating the regulatory framework where ascribe the protection of a software, on the basis of the dichotomy between literary work and invention. Indeed, a software is, first and foremost, a language, i.e. a set of computer instructions that builds a computer program. If this expression is characterized by creativity and originality, the protection to be invoked will be provided by Copyright. When a software can develop a further technical effect and solve technical problem, there could be the requirements for a patent protection. In the medical field, software, including Apps, is becoming a constant aid for healthcare professionals. In addition to the difficulty in identifying the invocable protection, the validation and use of software and Apps can be subject to the granting of the necessary authorizations.
