РОЛЬ ПРАВОВИХ ПЕРЕВАГ У РЕАЛІЗАЦІЇ ПРАВООХОРОННОЇ ДІЯЛЬНОСТІ ДЕРЖАВИ ТА ПРОФІЛАКТИЦІ ПРОТИПРАВНОЇ ПОВЕДІНКИ

Abstract

Ukraine, pursuing the goal of transforming and improving public life, certainly raises the issue of law enforcement, protection and defence of the rights, freedoms and legitimate interests of citizens. An important place in this process is occupied by regulations, standards, rules of conduct. The state of Ukraine's social, economic and legal systems convinces us that it is impossible to regulate public relations only by observing prohibitions and restrictions. More flexible phenomena should be used to motivate an enterprising person in the conditions of European integration. A typical example is a legal advantage. The article examines the role of legal advantages in the implementation of law enforcement activities of the state and the prevention of illegal behaviour. The application of the formal-legal and comparative-legal method allows for the establishment of specific essential and substantive features of the advantages in law. More flexible phenomena should be used to motivate an enterprising person in the conditions of European integration. A typical example is a legal advantage. It is established that the consolidation of advantages as a legal means of law enforcement policy of the state provides: guarantees of a differentiated approach in prosecuting various entities through the implementation of their special legal status (advantages in the form of immunity); conducting the most effective state financial and economic, social and fiscal policy, stimulating compliance with financial discipline (privilege); the regime of permission due to the creation of conditions of the maximum assistance that promotes the achievement of results of the state, official and public activity of subjects of relations. Improving national legislation requires theorists and practitioners of systematic legal thinking, consistent implementation of views and ideas, innovative approaches to their implementation. In the process, harmony must be achieved. In relation to the issue, such a balance can be realized between the imperative approach and the dispositive, norm-prescription and permission, limitations and advantages. Only scientifically verified, substantiated, and skilful use of all existing means and methods of legal regulation will contribute to the achievement of the planned plans. The effectiveness of the state's activities to prevent, detect and document offences is largely determined by the implementation of such legal remedies as benefits.
