Civil procedure exceptions, along with procedural sanctions are the main pillars of the civil procedure. This article analyses the exception of tardiness in the civil procedure and the difficulties which occur upon its invocation and examination. In particular, it refers to the right of the participants in the process to raise the exception of tardiness, its admission or rejection by the court, loss of right to raise the exception of tardiness, exception to the general rule to raise the exception of tardiness, courtrsquo;s empowerments to examine this procedural defence and case study. Suggestions are made to improve the legal framework, capable of offering solutions to the nuanced issues.

Excepțiile de procedură civilă, de rând cu sancțiunile procedurale, sunt pilonii de bază ai procesului civil. În prezentul articol se analizează excepția de tardivitate în procedura civilă și dificultățile ce apar la invocarea și examinarea acesteia. În special, sunt abordate dreptul participanților la proces de a invoca excepția de tardivitate, admiterea sau respingerea acesteia, decăderea din acest drept, excepțiile de la regulă, împuternicirile instanței de judecată la examinarea acestei apărări procesuale și studiu de caz. Sunt înaintate propuneri de îmbunătățire a cadrului legal susceptibile să ofere soluții la problemele nuanțate.
