Abstract

Determinarea momentului consum��rii infrac��iunii constituie una dintre problemele de baz�� ale teoriei dreptului penal ��i ale practicii judiciare. Determinarea corect�� a momentului consum��rii infrac��iunii constituie una din garan��iile ��ncadr��rii juridice adecvate ��i corecte a faptelor comise, ��i respectiv, a legalit����ii tragerii f��ptuitorului la r��spundere penal�� ��i aplicarea fa���� de acesta a unei pedepse echitabile. Autorul a ��ncercat s�� puncteze asupra importan��ei studierii institu��iilor juridico-penale analizate ��i a prezentat unele opinii ale cercet��torilor preocupa��i de tema abordat�� ��n prezentul articol, aduc��nd argumente ��n sprijinul actualit����ii unei astfel de investiga��ii. Articolul are ca obiect de studiu definirea infrac��iunii consumate ��i momentul consum��rii infrac��iunii, se prezint�� unele reflec��ii asupra momentului faptic al consum��rii ��i celui juridic al consum��rii infrac��iunii.
