Abstract

Nella decisione VG Bild-Kunst la Corte di Giustizia dell’Unione Europea stabilisce che l’art. 3, par. 1, della dir. 2001/29/Ce sul diritto d’autore nella società dell’informazione che regola il diritto di comunicazione al pubblico deve essere interpretato nel senso che costituisce una comunicazione al pubblico ai sensi di tale disposizione il fatto di incorporare, mediante la tecnica del framing, in una pagina Internet di un terzo, opere protette dal diritto d’autore e messe a disposizione del pubblico in libero accesso con l’autorizzazione del titolare del diritto d’autore su un altro sito Internet, qualora tale incorporazione eluda misure di protezione contro il framing adottate o imposte da tale titolare. La decisione costituisce una pericolosa estensione del diritto di comunicazione al pubblico e della nozione di misure tecnologiche di protezione prevista dall’art. 6 della dir. 2001/29/Ue che rischia di avere un impatto negativo sul Web nonché sulla libertà di pensiero e informazione.

In the VG Bild-Kunst decision the CJEU commented on art. 3 par. 1 of copyright InfoSoc 2001/29/EC directive which regulates the right of communication to the public. The court held that the provision must be interpreted as meaning that the embedding, by means of the technique of framing, in a third party website page, of works that are protected by copyright and that are freely accessible to the public with the authorisation of the copyright holder on another website, where that embedding circumvents measures adopted or imposed by that copyright holder to provide protection from framing, constitutes a communication to the public. The decision represents a dangerous extension of the right of communication to the public and of the notion of technological protection measures included in the art. 6 of the InfoSoc directive, and it can have a negative impact on the Web and on the freedom of expression and information.
