This essay aims to analyze the conflict between the provision of public security in times of a pandemic and the interest of individual freedom, in addition to the legislative implications in the field of fundamental norms, their problems and meanings. The method is hypothetical-deductive for data collection, and bibliographic and documentary analysis. The objective is to prove the hypothesis that there is legitimacy in the state recommendations in terms of proposing isolation during the pandemic, even though it is not always legal. It is concluded in order to attribute to the current state of affairs of the pandemic the factor capable of providing mobilization on the part of states and municipalities.
