During the coronavirus/ Covid-19 crisis, the Open Library responded to the closing of physical libraries by lifting the 'one user at a time' restriction on its 'Controlled digital lending' to create the 'National Emergency Library'. The lawsuit in question is ‘Hachette Book Group, Inc. v. Internet Archive (1:20-cv-04160) District Court, S.D. New York’. The lawsuit challenges the ‘Open Library’ provided by the Internet Archive, which has been available since 2006.
