Abstract

Nel periodo di affermazione della dominazione viscontea, la repressione penale dei reati di iniuria e di insultus riguardanti, direttamente o indirettamente, le magistrature comunali, attuata attraverso l’interazione fra legislazione statutaria e prassi giudiziaria, consente di riflettere sugli intrecci tra diritto e politica e, in particolare, sulle strategie giuridiche utilizzate dai Visconti per consolidare il proprio potere, nella continua tensione fra accentramento e autonomia. Da un lato, la punizione delle aggressioni verbali o fisiche commesse contro o alla presenza del podestà e della sua familia ovvero all’interno del palazzo municipale consentì di mantenere le forme di tutela penale delle magistrature comunali che si erano consolidate all’interno delle comunità cittadine, assicurando stabilità politica e sociale nel territorio. Dall’altro, tali forme di tutela corrisposero all’idea che gli attentati alle autorità municipali, ormai espressione del potere signorile, dovevano essere considerati attentati alla persona del princeps, rafforzando la protezione del signore.

In the period when the Viscontis extended their supremacy, the repression, resulting from the interaction between statutory law and case law, of crimes of iniuria and insultus affecting directly or indirectly municipal officials gives significant insights about the relationship between law and politics and, in particular, about legal strategies used by the Viscontis in order to consolidate their power, balancing out centralization and autonomy. On the one hand, the punishment of verbal and physical assaults against or in front of the potestates or their familia or in the municipal palaces allowed to keep traditional criminal protection of municipal officials, thus ensuring political and social stability. On the other hand, since the potestates were chosen by the Viscontis, these protective measures corresponded to the idea that attempts on municipal officials had to be considered as attemps on the princeps, thus streghtening the defence of the Viscontis.
