CERCETĂRI ȘTIINȚIFICE EFECTUATE ÎN REPUBLICA MOLDOVA CU PRIVIRE LA RĂSPUNDEREA PENALĂ PENTRU PRACTICAREA ILEGALĂ A ACTIVITĂȚII FINANCIARE

Abstract

Throughout this scientific article we aim to analyse scientific materials on criminal liability for the illegal practice of financial activity, published in the Republic of Moldova. Ab initio, we note that the doctrinal works contribute, in a primary and essential way, to the elucidation of the constitutive elements of the crime provided by art.2411 of the Criminal Code and the aggravating circumstance, as well as the demarcation between this crime and other related criminal / non-criminal acts. Also, the analysis of the theses and conceptions of the scientists facilitates the interpretation of the content of the incriminating norm and the identification of the qualification rules of the prejudicial facts according to art.2411 of the Criminal Code. Moreover, we believe that the research of scientific materials will lead us to remember which are the fiercest controversies and divergences that theorists and practitioners face. But, most importantly, the doctrine contributes to the analysis of the technical-legislative quality of art.2411 of the Criminal Code for the identification of the gaps of the norm in question, and therefore, the submission of the proposals of lex ferenda for the improvement of the incriminating framework in the matter.

În acest articol ne propunem să analizăm unele materiale științifice publicate în Republica Moldova, în care este abordată răspunderea penală pentru practicarea ilegală a activității financiare. Ab initio, remarcăm că lucrările doctrinare contribuie, în mod primordial și esențial, la elucidarea elementelor constitutive ale infracțiunii prevăzute de art.2411 CP RM și a circumstanței agravante, precum și la demarcația dintre această infracțiune și alte fapte penale/nepenale conexe. De asemenea, analiza tezelor și a concepțiilor oamenilor de știință facilitează interpretarea conținutului normei incriminatoare și identificarea regulilor de calificare a faptelor prejudiciabile potrivit art.2411 CP RM. Mai mult, considerăm că cercetarea respectivelor materiale științifice ne va determina să reținem care sunt cele mai aprigi polemici și divergențe cu care se confruntă teoreticienii și practicienii. Dar, cel mai important, doctrina contribuie la analiza calității tehnico-legislative a art.2411 CP RM pentru identificarea lacunelor normei în cauză, urmând a fi înaintate propuneri de lege ferenda pentru perfecționarea cadrului incriminator în materie
