The Dublin Regulation establishes theMember State responsible for the examination of theasylumapplication. The criteria for establishingresponsibilityrun, in hierarchicalorder, fromfamilyconsiderations, to recent possession of visa or residence permit in a Member State, towhethertheapplicanthasentered EU irregularly, or regularly. The Dublin Convention was signed in Dublin, Ireland on 15 June 1990, and first came intoforce on 1 September 1997 for thefirst 12 signatories. The Treaty has been extended toother EU Member States and some countrie outside the European Union. The Dublin Convention was replaced by Council Regulation No 343/2003 (Dublin II regulation). Its validity ended on 16 March 2003. The Dublin III entered intoforce in July 2013 and it contains sound procedures for the protection of asylumapplicants and improves the system’s efficiency. Despite the criticisms of the regulations, we believe that a single regulatory systemis vital and natural for the EU, especially in times of crisis.
