Abstract

Deponering adalah pelaksanaan azas oportunitas yaitu penyampingan perkara demi kepentingan umum. Deponering diatur dalam Undang-Undang Nomor 14 Tahun 2004 tentang Kejaksaan, namun dalam pengaturannya terdapat kekaburan norma dimana tidak jelas dari batasan-batasan dari kepentingan bangsa, negara dan masyarakat luas. Hasil analisa kepentingan umum sebagaimana di tentukan Pasal 35 (c) Undang-Undang Kejaksaan menjelaskan bahwa kepentingan umum adalah kepentingan bangsa dan negara dan/atau kepentingan masyarakat luas. Namun kepentingan umum tersebut tidak menjelaskan secara limitatif bagimana rumusan atau difinisi serta batasan dari kepentingan umum tersebut, hal ini berimplikasi terhadap penggunaan deponering oleh Jaksa Agung yaitu menyebabkan salah tafsir oleh Jaksa Agung dan timbul penafsiran yang beragam antara lembaga negara, kemudian status tersangka bagi pihak yang di deponering menjadi tidak jelas apakah masi berstatus tersangka atau status tersangka seketika hilang jika dikeluarkan deponeringKata kunci : Asas Oportunitas; Deponering; Kepentingan Umum.ABSTRACT Deponering is the implementation of the principle of opportunity which is the assistance of the case for the sake of the public interest. Deponering is regulated in law no 16 of 2004 on the Attorney Office, but in the regulation there is a blurring of norms where there is no clear boundary restriction of the interest of the Nation. The state and the public. Result of the analiysis the general interest as defined in Article 35(c) of the public Prosecution Law makes it clear that the public interest is in the interest of the nation and the state and / or the interest of the wider community, but the general interest arragment does not define limitatively how the formulation or difinition and limitations of the public interest has implications for deponering’s use by the Prosecutor-General, causing misinterpretations by the Prosecutor-General and varying interpretations between state institutions, and the suspect’s status for the underwritten party becomes unclear whether or not the suspect’s status or suspect status is lost when deponering.Keywords : Principality of Opportunity; Deponering; Pubic Interest.DOI 10.5281/zenodo.3631094 Â
