Abstract

Resumen: Las mujeres señaladas como “malas” madres desde los criterios de las ciencias jurídicas y las ciencias de la salud, emprenden un camino sinuoso de resistencia, desafío y alegato ante las instancias, penal o civil, según sea la gravedad de la falta, para demostrar su aptitud materna. El presente trabajo tiene como propósito conocer cómo, a través de los distintos dispositivos de normalización diseñados en los dominios de saber, se producen a las “malas” madres y a su vez, cómo se sancionan y regulan sus prácticas “desviantes” en el estado de Puebla. Por un lado, la psicología y psiquiatría combinan una serie de técnicas (diagnóstico clínico, valoraciones psicológicas o psiquiátricas, entre otros) para determinar la capacidad mental y emocional de la madre que asegure el bienestar del hijo. Por otro lado, las ciencias jurídicas desarrollan una serie de códigos reguladores de conductas cuyo propósito es asegurar que la madre que atenta contra la integridad del menor reciba una penalización, un castigo de acuerdo con su grado de maldad y a la vez “asegurar” que cumpla con el mandato materno. Abstract: Women identified as “bad” mothers from the criteria of legal sciences and health sciences, embark on a winding path of resistance, defiance and plea before the instances, criminal or civil authorities, depending on the severity of the offense, to demonstrate their maternal ability. The purpose of this work is to know how, through the different standardization devices designed in the domains of knowledge, “bad” mothers are produced and in turn, how their “deviant” practices are sanctioned and regulated in the state of Puebla. On one hand, psychology and psychiatry combine a series of techniques (clinical diagnosis, psychological or psychiatric assessments, among others) to determine the mental and emotional capacity of the mother that ensures the welfare of the child. On the other hand, the legal sciences develop a series of regulatory codes of conduct whose purpose is to ensure that the mother who violates the integrity of the child receives a penalty, a punishment according to her degree of evil and at the same time “ensure” that she meets with s with maternal mandate.
