Abstract This paper has as purpose to clarify what the preparative acts and the execution in attempt are, which will be done from a critical review of the state of the art on the concept of the attempt, its kinds, the Iter Criminis, and will end with the study of the dogmatic theories that establish the criteria that seek to find answers to settle the differences between the preparatory acts (not punishable) and those of execution (punishable), a difference that will have as a final focus the concretion of the real and certain risk to the protected legal good. Resumen El presente trabajo tiene como objeto la delimitación de los actos preparatorios y ejecutivos en la tentativa, labor que se hará a partir de una revisión crítica del estado del arte sobre el concepto de la tentativa, sus clases, el Iter Criminis, y finalizará con el estudio de las teorías dogmáticas que establecen los criterios que buscan decantar puntos de solución que permitan zanjar las diferencias entre los actos previos (no punibles) y los de ejecución (punibles), diferencia que tendrá como enfoque final la concreción del riesgo real y cierto al bien jurídico tutelado.
