Virtualización del espacio público y concepto débil de privacidad. Lecciones del caso Facebook-Cambridge Analytica

Abstract

Las democracias liberales afrontan el desafío de garantizar el derecho a la privacidad en un contexto sociotécnico caracterizado por el uso generalizado de las tecnologías de la información y el acceso a multitud de servicios, aplicaciones y plataformas de interacción virtual. Los aspectos positivos asociados con esta ampliación del espacio público abren nuevas posibilidades para el activismo político y refuerzan la eficacia de los demás cauces de participación ciudadana. Su contrapartida ha sido una atenuación del concepto de privacidad que excede lo razonable. Afianzada sobre una dinámica de intercambios comerciales en la cual los consumidores obtienen servicios gratuitos o pequeños descuentos a cambio de la cesión de datos personales, el debilitamiento del derecho a la privacidad constituye un proceso inexorable al que se han sumado con entusiasmo Estados inequívocamente totalitarios y democracias hipervigilantes.
