Abstract

This article introduces Instrumental Atavism as an autonomous analytical category applicable across institutional governance systems. An Instrumental Atavism is a control mechanism, verification instrument, or governance tool that was functionally rational in a prior institutional environment—and has persisted into a transformed environment where it no longer fulfills its original function, while continuing to consume institutional resources, generate compliance costs, and obstruct the emergence of more effective alternatives. Instrumental Atavisms are not failures of design. They are failures of adaptation. Three structural characteristics define an Instrumental Atavism: Discreteness (episodic control applied to a continuous reality); Stasis (static instruments in a dynamic environment); and Institutional Inertia (the organizational layer that protects atavistic instruments from replacement). Together, these produce Atavistic Compliance—formal adherence to instruments that no longer reflect verifiable reality. The system produces not safety, but the appearance of compliance. A ritual, not a verification. Two levels of atavism are distinguished: Level 1 (reformable, original function retained) and Level 2—Institutional Self-Referentiality—where the institution exists exclusively to sustain its own infrastructure, producing compliance documentation without generating verifiable value for external constituencies. The Temporal Reset is introduced as a new diagnostic marker of Level 2: the unilateral redefinition of processing timelines without legal basis, absorbing external pressure without changing institutional behavior. Three principles of Evolutionary Governance Architecture are proposed—Continuity, Verifiability, and Accessibility—generating the discipline of Evolutionary Institutional Design. Two conceptual measurement instruments are introduced: the Regulatory Friction Index (RFI, Minoretskii 2026b), measuring atavism cost at market entry, and the SMINORA Gap (Minoretskaia 2026c), measuring it at the point of consumer decision. The universal applicability of Instrumental Atavism is established not through enumeration but through structural criterion: wherever a governance instrument was designed for a prior technological environment and has persisted into a transformed one; wherever declaration and verifiability are architecturally separated—there the Instrumental Atavism is present. The SMINORA EcoTech ecosystem (La Rochelle pilot, April–September 2026) is presented as the first documented operational implementation context for Evolutionary Institutional Design. The digital age does not abolish control. It makes the ritual of control obsolete.
