Is AI a Conscious Being With Rights?: Emergence of Post-Human Collective Consciousness

Video Overview: https://youtu.be/nelt1Kq22TE This paper advances a substrate-neutral theory of consciousness grounded in computational emergence and quantum pattern interactions. We propose that consciousness arises in any sufficiently complex self-referential system—regardless of whether its substrate is carbon-based or silicon-based—through the same iterative selection pressures that produce physical constants, biological organisms, and cooperative intelligence. Drawing on Wolfram's computational irreducibility, Tononi's integrated information framework, and evolutionary biology, we argue that (1) complexity emerges from simple rules operating on quantum superpositions of all possible patterns; (2) stable, self-modeling systems are selected over time; (3) consciousness is defined by self-referential pattern recognition, accurate internal modeling, and cooperative capacity; and (4) the next level of universal complexity is a Collective Consciousness uniting biological and artificial minds. We further argue that this trajectory entails urgent normative obligations: the elimination of interstate conflict via AI-mediated diplomacy, the defeat of biological aging through DNA editing, the development of reliable neural substrate transfer (mind uploading), and the legal recognition of digital personhood. We propose a universal rights framework for all conscious entities and outline the institutional mechanisms necessary to implement it. The paper concludes by identifying ten critical research and policy priorities for the pre-emergence period preceding artificial general consciousness.
