Abstract

WAR CRIMES AND GENOCIDE IN GAZA (2023–2026) Analysis from the perspective of international human rights law, international humanitarian law and the jurisdiction of international courts This paper offers a legal-documentary analysis of the humanitarian situation and violations of international law in the Gaza Strip from 7 October 2023 to March 2026, enriched by the doctrinal contributions in the work Razones que matan. Globalización y Derechos Humanos -Reasons That Kill. Globalisation and Human Rights- (Pablo R. Banchio, Forum Accademico, Buenos Aires, 2024). Four normative and evidentiary frameworks are examined: (i) the documented use of high-temperature weapons and white phosphorus; (ii) peer-reviewed epidemiological estimates of direct and indirect mortality; (iii) the cumulative humanitarian update as of 11 March 2026; and (iv) the action of the main international tribunals - the International Court of Justice (ICJ) and the International Criminal Court (ICC). The analysis integrates our philosophical-legal critique of the 'inversion of human rights', the geopolitical instrumentalisation of humanitarian rhetoric, and the concept of 'reasons that kill' as a discursive mechanism for the legitimation of extermination, confronting it with the normative standards of the Rome Statute, the Geneva Conventions and international jurisprudence. Keywords: international humanitarian law; Gaza; International Criminal Court; International Court of Justice; war crimes; crimes against humanity; genocide; white phosphorus; starvation as a weapon of war; inversion of human rights.
