A Legal Perspective: A Study of the Provisions of Criminal Medical Liability for Abortion Procedures between Criminalization and Medical Necessity in Algerian Legislation

Abstract

This paper aims to provide an analytical legal perspective on the provisions governing criminal medical liability for abortion procedures under Algerian legislation, by examining the limits between criminalization and the exception grounded in medical necessity, within the framework of balancing the protection of the fetus’s right to life and the safeguarding of the mother’s physical and psychological integrity. The study analyzes the legal structure of the crime of abortion committed by a physician through examining its constituent elements, namely the presumed element, the material element, and the moral element, while also addressing its various forms as regulated under Articles 304 to 313 of the Algerian Penal Code, in addition to reviewing the principal and supplementary criminal penalties applicable where medical criminal liability is established. The paper further explores the legal scope of therapeutic abortion as the sole statutory exception to criminal liability pursuant to Article 308 of the Penal Code and the provisions of Law No. 18-11 relating to health, insofar as such intervention is required to protect the mother’s life or her physical and psychological stability when seriously threatened by pregnancy. The study concludes by emphasizing the necessity of refining the criteria governing medical necessity and strengthening the legislative balance between criminal protection of fetal life and the demands of contemporary medical developments in a manner consistent with the specificities of the Algerian legal system.

تهدف هذه الورقة إلى تقديم رؤية قانونية تحليلية لأحكام المسؤولية الجنائية الطبية عن عمليات الإجهاض في التشريع الجزائري، من خلال دراسة حدود التجريم والاستثناء المرتبط بحالة الضرورة الطبية، وذلك في سياق التوازن بين حماية حق الجنين في الحياة وضمان سلامة الأم الجسدية والنفسية. وقد تناولت الورقة الإطار القانوني لجريمة الإجهاض المرتكبة من طرف الطبيب عبر تحليل أركانها القانونية المتمثلة في الركن المفترض والركن المادي والركن المعنوي، مع بيان صورها المختلفة المنصوص عليها في المواد 304 إلى 313 من قانون العقوبات الجزائري، واستعراض الجزاءات الجنائية الأصلية والتكميلية المقررة في حق الطبيب عند قيام مسؤوليته الجزائية. كما عالجت الورقة نطاق الإباحة المرتبط بالإجهاض العلاجي باعتباره الاستثناء الوحيد المقرر قانونًا وفقًا للمادة 308 من قانون العقوبات وأحكام القانون رقم 18-11 المتعلق بالصحة، بما يكرّس حماية حياة الأم أو توازنها الصحي والنفسي عند تعرّضها لخطر مؤكد بسبب الحمل. وخلصت الدراسة إلى ضرورة تدقيق معايير الضرورة الطبية وتعزيز التوازن التشريعي بين متطلبات الحماية الجنائية للجنين ومقتضيات التطور العلمي في المجال الطبي بما ينسجم مع خصوصية المنظومة القانونية الجزائرية.
