Abstract

Il contributo analizza l’emergere della rigenerazione urbana quale nuovo paradigma del diritto del territorio contemporaneo, nel quadro delle politiche europee di sostenibilità e contenimento del consumo di suolo. Muovendo da una ricostruzione sistematica della nozione di rigenerazione urbana, il lavoro distingue tale concetto dalla tradizionale riqualificazione edilizia, evidenziandone la natura di processo integrato che coinvolge dimensioni urbanistiche, ambientali, economiche e sociali. L’articolo esamina il quadro normativo multilivello della materia nell’ordinamento italiano, caratterizzato dall’assenza di una disciplina statale organica e dal ruolo centrale delle legislazioni regionali e della pianificazione locale. In tale contesto viene analizzata la proposta di legge S.29/2025, che mira a introdurre una cornice normativa nazionale fondata su strumenti di programmazione territoriale, incentivi urbanistici e modelli di governance multilivello. Particolare attenzione è dedicata alla giurisprudenza costituzionale e amministrativa che ha progressivamente delineato i limiti giuridici delle politiche di rigenerazione urbana, con specifico riferimento alla sentenza della Corte costituzionale n. 51 del 2025. L’analisi evidenzia come la rigenerazione urbana non possa essere ridotta a un insieme di interventi edilizi incentivati, ma debba essere interpretata come processo pianificatorio integrato, nel quale la pianificazione urbanistica comunale costituisce il principale strumento di composizione tra sostenibilità ambientale, sviluppo urbano e autonomia democratica delle comunità territoriali.

This article examines the emergence of urban regeneration as a central paradigm in contemporary land-use law within the broader framework of European policies aimed at promoting sustainable urban development and limiting land consumption. Starting from a conceptual reconstruction of urban regeneration, the paper distinguishes this notion from traditional urban redevelopment, emphasizing its nature as an integrated process involving urban, environmental, social and economic dimensions. The study reconstructs the multi-level regulatory framework governing urban regeneration in the Italian legal system, highlighting the absence of a comprehensive national framework law and the pivotal role played by regional legislation and local urban planning. In this context, the article analyses legislative proposal S.29/2025, which seeks to establish a national regulatory framework based on territorial planning instruments, urban incentives and multi-level governance mechanisms. Particular attention is devoted to the role of administrative and constitutional case law in shaping the legal boundaries of urban regeneration policies, with specific reference to the decision of the Italian Constitutional Court no. 51 of 2025. The article argues that urban regeneration cannot be understood as a mere aggregation of building interventions but must instead be conceived as an integrated planning process in which municipal planning authority represents the institutional locus for balancing environmental sustainability, urban development and democratic territorial governance.
