Abstract

O presente trabalho propõe a Análise Econômica do Direito (AED) como uma das metodologias de pesquisa para a investigação de temas afetos ao Direito Financeiro e Orçamentário. Partindo da evolução histórica da AED, da Escola de Chicago à Análise Comportamental, o trabalho detalha seus pilares conceituais e a distinção entre as abordagens positiva e normativa. Demonstra-se a aplicação prática do método na formulação de problemas de pesquisa empíricos, no mapeamento de incentivos do processo orçamentário brasileiro e na construção de modelos preditivos para normas fiscais. Conclui-se que a integração da análise consequencialista da AED à dogmática principiológica oferece um caminho para aumentar a efetividade das políticas públicas, capacitando o pesquisador a avaliar as consequências reais das decisões financeiras do Estado em um contexto de recursos escassos.
