ADOECIMENTO PSÍQUICO E CONSTITUCIONALISMO SOCIAL: A SÍNDROME DE BURNOUT COMO INDICADOR DA CRISE INSTITUCIONAL

Abstract

O presente estudo propõe uma análise crítica e interdisciplinar entre o pensamento de Roberto Gargarella sobre o constitucionalismo latino-americano e a Síndrome de Burnout como fenômeno social. A partir da metáfora da “sala de máquinas” da Constituição, argumenta-se que a estrutura de poder das constituições latino-americanas permanece impermeável à efetivação dos direitos sociais, contribuindo diretamente para o adoecimento psíquico de trabalhadores. O estudo adota metodologia qualitativa e bibliográfica, demonstrando que a inércia institucional e a exclusão democrática comprometem a promessa constitucional de trabalho digno e saúde mental. Ao final, propõem-se diretrizes para uma recomposição democrática da estrutura constitucional, compatível com os compromissos assumidos nos textos normativos. O burnout, nesse contexto, é compreendido como sintoma da falência das constituições sociais e da urgência de uma reforma institucional profunda.
