Abstract

Analisa-se no presente estudo, a problemática envolvendo o anonimato dentro dos processos heterólogos, que utilizam do contributo genético de terceiros doadores. Concretamente, questionamos se o surgimento de um direito fundamental ao conhecimento das origens genéticas implica, necessariamente, numa obrigatoriedade constitucional de regimes jurídicos mais liberais, que permitam o conhecimento da identidade desses intervenientes no processo reprodutivo, como quer fazer crer o Tribunal Constitucional português, no julgamento do acórdão n.º 225/2018. Oportunamente, aproveitamos a discussão para tecer algumas considerações críticas sobre o novo regime de anonimato estabelecido pela Lei n.º 48/2019, de 8 de julho.

In the present study, we analyze the problem involving anonymity in heterologous processes, which use the genetic contribution of third-party donors. Specifically, we question whether the emergence of a fundamental right to know one's genetic origins necessarily implies a constitutional obligation of more liberal legal regimes that allow the knowledge of the identity of those involved in the reproductive process, as the Portuguese Constitutional Court would have us believe, in the judgment of judgment no. 225/2018. In due course, we will use this discussion to make some critical remarks about the new anonymity regime established by Law no. 48/2019, of July 8.
