El derecho a la prueba en los procesos laborales. A propósito de la regla "no se presume"

Abstract

El presente trabajo analiza el derecho a la prueba en el proceso laboral peruano a partir de la regla contenida en el artículo 37 del TUO del Decreto Legislativo 728, según la cual «ni el despido ni el motivo alegado se deducen o presumen, quien los acusa debe probarlos». Tomando como caso de referencia la Casación N.° 15624-2022-Lima, se examina la estructura probatoria de la demanda de indemnización por despido arbitrario: la hipótesis de incidencia normativa y su thema probandum, el efecto de las presunciones legales sobre dicho thema, la figura de las verdades interinas, la distribución de la carga de la prueba y la inferencia indiciaria como forma legítima de razonamiento probatorio. Se emplean esquemas argumentativos —Toulmin y Walton— para hacer visible la estructura del razonamiento sobre los hechos y se plantea, como cuestión pendiente, el problema del control casatorio de las cuestiones de hecho.
