Abstract

The purpose of this article is to discuss objective good faith in the context of commercial contracts, with an emphasis on the case law of the Superior Court of Justice. By going through a broad historical and doctrinal scope, the integrative, corrective and interpretive functions will be outlined, with their respective objectives, such as the duty to inform, to protect, loyalty and protection, applied to the pre-contractual phase, to finally, adopting a qualitative-quantitative statistical methodology, proceed to the analysis of the judgments published by the Superior Court of Justice. Finally, with the data analyzed, we hope to help other researchers on the proposed topic, showing that, regardless of the rate at which appeals are upheld by the Superior Court, it has recognized the application of the objective good faith to the pre-contractual phase, in accordance with the provisions of Brazilian legal doctrine.

O presente artigo destina-se a discutir a boa-fé objetiva, no âmbito dos contratos empresariais, com ênfase na jurisprudência do Superior Tribunal de Justiça. Ao perpassar por amplo escopo histórico e doutrinário, serão delineadas as funções integrativa, corretiva e interpretativa, com seus respectivos consectários, tais como o dever de informar, de proteger, de lealdade e proteção, aplicadas à fase pré-contratual, para, enfim, adotando-se uma metodologia estatística quali-quantitativa, proceder à análise dos acórdãos publicados pelo Superior Tribunal de Justiça. Por fim, com os dados analisado, espera-se auxiliar outros pesquisadores quanto ao tema proposto, mostrando que, independentemente da taxa de provimento dos recursos na Corte Superior, esta tem reconhecido a aplicação da boa-fé objetiva à fase pré-contratual, em consonância com o disposto na doutrina jurídica brasileira.
