Abstract

O presente artigo tem por objetivo verificar de que maneira as relações de avosidade são ressignificadas pelo reconhecimento social do envelhecimento e da tese jurídica da multiparentalidade socioafetiva. Trata-se de um tema novo e pouco explorado no Direito de Família, com relevância prática em face dos efeitos do crescimento da população idosa e da longevidade nas famílias e nos institutos jurídicos. Para tanto, inicialmente investiga-se as vinculações entre os conceitos de “envelhecimento”, “longevidade” e “avosidade” para, num segundo momento, compreender as formas de proteção e vinculações jurídicas entre avós e netos sob a ótica jurídica do Direito das Famílias. Por fim, analisa-se as possíveis ressignificações nas relações de avosidade a partir da ampliação da proteção dos avós idosos e da recepção das teses da socioafetividade e da multiparentalidade. Trata-se de pesquisa teórica, de caráter descritivo, com a utilização de método monográfico e dedutivo, baseado em fontes primárias e secundárias.

This article aims to verify how the relations of grandparenthood are re-signified by the social recognition of aging and the legal thesis of socio-affective multiparenthood. This is a new and little explored topic in Family Law, with practical relevance in view of the effects of the growth of the elderly population and longevity on families and legal institutes. To this end, I initially investigate the links between the concepts of "aging", "longevity" and "grandparenthood" to, in a second moment, understand the forms of protection and legal links between grandparents and grandchildren from the legal perspective of Family Law. Finally, it analyzes the possible resignifications in the relations of grandparenthood from the expansion of the protection of elderly grandparents and the reception of the theses of socio-affectivity and multiparenting. This is a theoretical research, descriptive in nature, using monographic and deductive method, based on primary and secondary sources.
