
In light of scientific and technological advancements and the increasing need for food due to the depletion of natural and animal resources, scientists have turned to the use of genetic engineering in agriculture and animal husbandry. This is achieved through genetic modification of plants and animals to make genetic changes as a fundamental solution to various issues related to increasing agricultural production efficiency and improving its quality at a lower cost. This is aimed at obtaining products with better features and producing plants and animals of great importance to human nutrition in quantities that meet the growing demand in order to address the problem of food scarcity. As a result, the production of a new variety of these organisms now takes only a few years using genetic engineering, as opposed to decades. Despite the benefits of using genetic engineering in producing genetically modified foods, it raises concerns about its impact on consumer health and its environmental implications. This study sheds light on the legal mechanisms that protect consumers from the harm of genetically modified food products. It does so by legally embodying the principle of caution as a mechanism to protect consumers from genetically modified foods in Algerian legislation. It also outlines the obligations imposed on those involved and the penalties incurred when they breach their civil liability by compensating consumers harmed by genetically modified food products.
في ظل التقدم العلمي والتقني والحاجة المتزايدة للغذاء بسبب استنزاف الموارد الطبيعية والحيوانية، اتجه العلماء إلى استخدام تقنية الهندسة الوراثية في المجال الزراعي والحيواني، وذلك عن طريق التعديل الوراثي (الجيني) للنباتات والحيوانات، لإجراء تحسينات تعتمد على احداث تغييرات في التركيبة الوراثية كحل أساسي لعدد من المشكلات المتعلقة بزيادة كفاءة الإنتاج الزراعي وتحسين جودته بأقل تكلفة، للحصول على منتجات بميزات أفضل، وانتاج نباتات وحيوانات ذات أهمية كبرى للإنسان في غذائه وبكميات تلبي الطلبات المتزايدة بهدف القضاء على مشكلة نقص الغذاء، وبالتالي أصبح انتاج صنف جديد من هذه الكائنات يستغرق فقط بضعة سنوات باستخدام الهندسة الوراثية بدلا من عشرات السنوات. وبالرغم من فوائد استخدام الهندسة الوراثية في انتاج أغذية معدلة وراثيا، إلا أنها تثير مخاوفا بشأن تأثيرها على صحة المستهلك وزيادة الضغط على البيئة. جاءت هذه الدراسة لتسليط الضوء على الآليات القانونية التي تحمي المستهلكين من أضرار المنتجات الغذائية المعدلة وراثيا، وذلك من خلال التجسيد القانوني لمبدأ الحيطة كآلية لحماية المستهلك من الأغذية المعدلة وراثيا في التشريع الجزائري، وتعويض المستهلك المتضرر من المنتجات الغذائية المعدلة وراثيا.
