Abstract

En este documento se analizará detalladamente cómo la operación policial que culminó con la detención de un vehículo en el que viajaban nueve personas vinculadas al Cártel del Golfo en Tamaulipas —entre ellas Alfredo Cárdenas Martínez, alias “El Contador”, señalado por delitos como extorsión y tráfico de armas— puede relacionarse directamente con la capacidad del Estado mexicano como sujeto principal del derecho internacional, conforme al Capítulo II del Manual de Derecho Internacional de López Mejía. En particular, se examina su supremacía interna, entendida como la autoridad suprema, exclusiva e incuestionable sobre la población tamaulipeca y el territorio nacional, la cual se vio desafiada por el crimen organizado. Asimismo, se considerará a los ciudadanos mexicanos —tanto víctimas de extorsión como jóvenes potencialmente reclutados por dicho cártel— como sujetos derivados del derecho internacional, con acceso pleno a mecanismos universales de protección de derechos humanos, como el Protocolo Facultativo del PIDCP, la Convención Americana sobre Derechos Humanos y las competencias de la CIDH, tal como lo establece la sección 6 del capítulo.
