Abstract

El Derecho Internacional reconoce al Estado como el principal sujeto jurídico dentro de la comunidad internacional. Para que cualquier ente pueda ser considerado Estado debe reunir ciertos elementos esenciales, como lo pueden ser: territorio, población, gobierno y soberanía. Estos elementos no solo tienen una función teórica, sino que constituyen la base del orden jurídico internacional y permiten que los Estados se relacionen entre sí bajo ciertos principios como la igualdad soberana, la no intervención y la solución pacífica de conflictos. Sin embargo, estos principios día a día se ven puestos a prueba en contextos de conflictos armados. Las guerras de nuestros tiempos no solo representan enfrentamientos militares, sino también crisis jurídicas, políticas y humanitarias que afectan la existencia misma de los Estados involucrados. Un ejemplo claro de esta situación (y el cual analizaremos en este ensayo), es el conflicto entre Rusia y Ucrania, el cual ha generado un debate internacional sobre la legalidad del uso de la fuerza, la violación de la soberanía y la estabilidad del sistema internacional
