Eleições e lógica algorítmica: um balanço recente

Abstract

O artigo analisa os impactos da lógica algorítmica sobre os processos eleitorais e o regime democrático, a partir do contexto das eleições brasileiras recentes. Examina, inicialmente, as alterações promovidas pelo Tribunal Superior Eleitoral na Resolução nº 23.610/2019, com destaque para regras relativas ao uso de inteligência artificial, proibição de deepfakes, combate à desinformação e ampliação da transparência e fiscalização do processo eleitoral. Em seguida, aborda conflitos institucionais envolvendo plataformas digitais e o Supremo Tribunal Federal, evidenciando tensões entre liberdade de expressão, soberania nacional e responsabilização de empresas globais. O texto incorpora o conceito de "capitalismo de vigilância", de Shoshana Zuboff, para problematizar o poder instrumentário exercido por corporações tecnológicas por meio da coleta e análise massiva de dados, capazes de influenciar comportamentos e preferências políticas. Argumenta-se que a opacidade dos algoritmos — o "segundo texto" inacessível aos usuários — cria assimetrias informacionais e riscos à integridade democrática, especialmente em países periféricos. Conclui-se pela necessidade de uma regulação que promova transparência algorítmica e proteção da soberania democrática, sem reduzir-se a censura, mas orientada à salvaguarda das instituições e da vontade popular.
