
the environmental crisis, exploding population, scarcity of fresh water for human consumption, unsustainable development, and implied recognition of the right to clean water are the motivations behind writing this analytical paper, so that the role of the judiciary could be examined more deeply and appreciated critically regarding the conception of the right to clean water in India. This paper will examine the context, select cases, and the environmental governance framework to identify the role of the Indian judiciary in developing and expanding the right to clean water discourse in India as a fundamental human right, considering both international and Indian rights regimes. Thus, this paper will use the egalitarian human rights framework as an analytical tool. This work will employ a doctrinal analysis method to examine and analyse the role played by the judiciary in the right to clean water discourse in India. In reviewing and analysing the role of the court in the right to clean water discourse, the author will view the space of courts as a public place where different kinds of theoretical, ideological, and philosophical approaches are contested in the language of the law, and new types of theorisations, conceptualization, and principles are developed by the judiciary in term of right and justice.
