Abstract

O presente artigo visa analisar a responsabilidade civil das entidades desportivas futebolísticas pelos atos discriminatórios realizados por seus torcedores, empregados, ou membros nos estádios. As legislações e codificações que regem o Direito Desportivo no Brasil estabelecem ao espectador e a entidade desportiva o caráter consumerista de consumidor e fornecedor no que concerne ao ambiente da prática desportiva. Nesse sentido, a partir da metodologia de pesquisa bibliográfica e jurisprudencial qualitativa, com base em bibliografias científicas, documentos monográficos, jurisprudências e exame da legislação, como o Código Civil (Lei n. 10.406/2002), a Lei Pelé (Lei n. 9.615/98), o Código de Defesa do Consumidor (Lei n. 8.078/90) e a Lei Geral do Esporte (Lei n. 14. 597/2023), busca-se compreender o instituto da responsabilidade civil e examinar a solução dada pelo Poder Judiciário e Desportivo aos danos morais causados pela prática de atos discriminatórios no ambiente futebolístico. Ademais, o presente trabalho busca investigar qual tem sido o limite da responsabilização suportada pelos entes futebolísticos pelos atos discriminatórios realizados por seus adeptos no ambiente desportivo.

This article aims to analyze the civil liability of football sports entities for discriminatory acts carried out by their fans, employees, or members in stadiums. The legislation and codifications that govern Sports Law in Brazil establish to the spectator and the sporting entity the consumerist character of consumer and supplier with regard to the sporting environment. In this sense, based on the methodology of qualitative bibliographic and jurisprudential research, based on scientific bibliographies, monographic documents, jurisprudence and examination of legislation, such as the Civil Code (Law n. 10,406/2002), Pelé Law (Law n. 9,615/ 98), Consumer Protection Code (Law n. 8.078/90) and General Sports Law (Law n. 14.597/2023), we seek to understand the institute of civil liability and examine the solution given by the Judiciary and Sports to moral damages caused by the practice of discriminatory acts in the football environment. Furthermore, the present work seeks to investigate what has been the limit of liability borne by football sports entities for discriminatory acts carried out by their fans in the sports environment.
