Abstract

Il contributo analizza l’impatto dell’intelligenza artificiale sull’attività forense e giudiziaria, con particolare riferimento all’uso distorto degli strumenti di IA e alle conseguenti responsabilità professionali e disciplinari. Muovendo dal quadro normativo europeo e nazionale, che qualifica come ad alto rischio l’impiego dell’IA per l’applicazione e l’interpretazione delle norme giuridiche, l’articolo esamina gli obblighi di trasparenza, supervisione umana e competenza gravanti su avvocati e magistrati. L’attenzione si concentra sulle prime pronunce giurisprudenziali in materia di c.d. allucinazioni giuridiche e sulle risposte dell’ordinamento, anche in prospettiva comparata. Il contributo evidenzia come l’intelligenza artificiale debba rimanere uno strumento di supporto, inserito in una cornice di responsabilità non delegabile, al fine di preservare l’autonomia del giudizio e il corretto funzionamento del sistema giustizia.

The article examines the impact of artificial intelligence on legal practice and judicial activity, focusing on the distorted use of AI tools and the resulting professional and disciplinary liability. Starting from the European and national regulatory framework, which classifies the use of AI for the application and interpretation of legal rules as high-risk, the paper analyses the obligations of transparency, human oversight and professional competence imposed on lawyers and judges. Particular attention is devoted to the first judicial decisions concerning so-called legal hallucinations and to the institutional responses adopted, also from a comparative perspective. The contribution argues that artificial intelligence must remain a support tool within a framework of non-delegable human responsibility, in order to safeguard judicial autonomy, legal certainty and the proper functioning of the justice system.
