El uso justificado de la vigilancia ante el derecho a la privacidad

Abstract

El presente ensayo analiza el uso de la vigilancia estatal frente al derecho fundamental a la privacidad, a partir de la jurisprudencia de la Corte Interamericana de Derechos Humanos y del Tribunal Europeo de Derechos Humanos. Tomando como referencia el caso Escher vs. Brasil, se examina cómo la vigilancia telefónica y la divulgación de conversaciones privadas constituyen injerencias ilegales en la vida privada cuando no están debidamente justificadas, motivadas y sujetas a control judicial. Asimismo, se retoman criterios del Tribunal Europeo, particularmente en contextos de seguridad nacional, para destacar que, si bien los Estados pueden implementar medidas de vigilancia, estas deben respetar los principios de legalidad, proporcionalidad y necesidad. Finalmente, el trabajo reflexiona sobre los desafíos actuales que plantea el avance tecnológico y la vigilancia masiva, advirtiendo el riesgo de vulneración de la privacidad y de otros derechos fundamentales en ausencia de controles efectivos.
