O Amor como discurso legitimador do Direito

Abstract

Exploramos o tema perfeitamente cientes de que o mesmo parece exótico, algo extravagante para aqueles que insistem em interpretar o Direito como uma ciência, agarrados ao (pre)conceito do racionalismo que nos foi inculcado pelo pensamento iluminista. Mas, pensar o homem como um animal político não permite ignorar a sua animalidade, a sua liberdade e os seus afetos. Assim, neste pequeno estudo perfunctório propomo-nos analisar a presença crucial do Amor como discurso legitimador do Direito.

We explore the topic fully aware that it seems exotic, something extravagant for those who insist on interpreting Law as a science, clinging to the (pre)concept of rationalism that was inculcated in us by Enlightenment thought. However, thinking of man as a political animal does not allow us to ignore his animality, his freedom and his affections. Therefore, in this small perfunctory study we propose to analyze the crucial presence of Love as a legitimizing discourse of Law.
